MS trial: Memo disallowed

The federal judge considering antitrust sanctions against Microsoft said Friday she will not consider a Microsoft memo in which a company executive urged retaliation against uncooperative computer makers.

U.S. District Judge Colleen Kollar-Kotelly denied a request by the nine states suing Microsoft to admit the August 2000 e-mail memo into evidence, saying it would "prejudice" the company's defense.

The states, which are pressing for severe sanctions against the company, had asked the judge to reconsider an earlier decision that shielded Microsoft Chairman Bill Gates from the e-mail message during his testimony.
